LANSING, MI (WKZO AM/FM) – The Michigan Cannabis Industry Association is suing the state over the 24% wholesale tax on marijuana that will take effect January 1 and was included in the Fiscal Year 2026 budget.
The tax will generate around $420-million a year and be put toward road improvements according to state officials.
The Michigan Cannabis Industry Association says the tax is a violation of the constitutional requirements for changing voter-initiated laws like that voters approved to legalize recreational marijuana in 2018.
They argue the law contends either voter approval or a three-fourths legislative vote needs to happen to make the change.
